Darlington Nurses Tribunal: Trans Changing Room Policy Found Discriminatory

An employment tribunal ruled that County Durham and Darlington NHS Foundation Trust had unlawfully discriminated against and harassed eight nurses by allowing a trans woman colleague to use the women's changing room without providing suitable alternatives. This was the first English employment tribunal to apply the For Women Scotland ruling, reaching the opposite conclusion to the Peggie and Kelly cases. The trans colleague was personally exonerated from harassment charges.

Impact & Significance

The conflicting judgment, alongside the Peggie and Kelly decisions, demonstrated that the law on trans access to single-sex spaces remains deeply uncertain at first-instance level, with all three cases likely heading to appeal.
